The pass cost $50 and the proceeds from the sale of the passes went to a fund used to research and implement technology to reduce carbon emissions known to pollute the air. Keep On Trucking, Inc., a large commercial shipping company incorporated in New York, whose trucks would sometimes drive through Oregon and therefore be required to purchase a pass, filed a lawsuit challenging Oregon’s law as being unconstitutional on the grounds that it violated both the Due Process Clause and the Commerce Clause.
